(“Virtumundo”, “we”, “us” and “our”) and govern your access to and use of our website currently located at mystockdata.com, and its subdomains (together with any third party services available therein, and any related or successor website(s) thereto, including blogs, community forums, or other discussion or informational websites; the “Site”) and the Virtumundo personal finance services which we make available to you via our Site (together with any third party services available therein, and any related or successor services, including applications, spreadsheet add-ons, add-ins, and support widgets; the “Services”). Please read these Terms carefully before using the Virtumundo Site and Services as they may have changed since your last visit.
BY USING THE SITE AND SERVICES YOU AGREE TO BE BOUND BY THESE TERMS. Virtumundo’s Site and Services are offered and available to users 18 years of age and older that reside in the United States of America. By using Virtumundo’s Site or Services you represent and warrant that you meet all the foregoing eligibility requirements. If you do not meet all these requirements, you must discontinue your use of Virtumundo’s Site and Services.
We may revise and update these Terms at our sole discretion. All changes are effective immediately upon posting or publication. NEITHER VIRTUMUNDO NOR THE SERVICE IS INTENDED TO PROVIDE LEGAL, TAX, INVESTMENT OR FINANCIAL ADVICE. The Service is intended only to assist you in your investment performance and decision-making and is broad in scope. Your personal investment situation is unique, and any information and advice obtained through the Service may not be appropriate for your situation. Linking Your Data Source Accounts to Virtumundo’s Services. YOU ACKNOWLEDGE THAT VIRTUMUNDO’S SERVICES, IN PART, FACILITATE THE RETRIEVAL OF YOUR FINANCIAL DATA WITH YOUR UP TO DATE DATA (“FINANCIAL DATA”) RETRIEVED FROM YOUR BANKS, CREDIT CARDS, BROKERAGES, LOANS, AND OTHER THIRD PARTY FINANCIAL SOURCES (“DATA SOURCES”). YOU ACKNOWLEDGE AND AGREE THAT VIRTUMUNDO MAY USE THE SERVICES OF THIRD PARTY SERVICE PROVIDERS (“DATA AGGREGATORS”) TO ACCESS YOUR FINANCIAL DATA ON YOUR BEHALF ON AN ON GOING BASIS FOR THE PURPOSE OF PROVIDING VIRTUMUNDO’S SERVICES TO YOU.
By using the Services, you authorize and direct Virtumundo, either directly or through Virtumundo’s Data Aggregators, to access your Data Source accounts that you designate, with the account log-in credentials that you provide, to retrieve your Financial Data, and to access accounts requested by you. FOR THE SOLE PURPOSE OF PROVIDING THE SERVICES, you hereby grant Virtumundo, either directly or through Virtumundo’s Data Aggregators, a limited power of attorney, and appoint Virtumundo, either directly or through Virtumundo’s Data Aggregators, as your attorney-in-fact and agent, with full power of substitution and resubstitution, for you and in your name, place and stead, in any and all capacities, to access third party internet sites, servers or documents, retrieve information, and use your information, all as described above, with the full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with such activities, as fully to all intents and purposes as you might or could do in person. YOU ACKNOWLEDGE AND AGREE THAT WHEN VIRTUMUNDO, EITHER DIRECTLY OR THROUGH VIRTUMUNDO’S DATA AGGREGATOR, ACCESSES, AND RETRIEVES INFORMATION FROM THIRD PARTY SITES, VIRTUMUNDO IS ACTING AS YOUR AGENT, AND NOT THE AGENT OR ON BEHALF OF THE THIRD PARTY. You agree that third party account providers shall be entitled to rely on the foregoing authorization, agency and power of attorney granted by you. You understand and agree that the Services are not endorsed or sponsored by any third party account providers accessible through the Services.
YOU HEREBY ACKNOWLEDGE THAT PLAID, INC. (“PLAID”) IS A VIRTUMUNDO DATA AGGREGATOR. ACCORDINGLY, VIRTUMUNDO’S SERVICES ARE CONNECTED OR LINKED TO YOUR DATA SOURCES BY PLAID. WHEN YOU REQUEST YOUR FINANCIAL DATA FROM A DATA SOURCE CONNECTED TO OUR SERVICES, Plaid COLLECTS THAT DATA AND PROVIDES IT TO US. PLAID ACTS ON OUR BEHALF IN THIS PROCESS, WHICH MEANS WE SHARE YOUR DATA WITH PLAID AS ONE OF OUR SERVICE PROVIDERS. FOR MORE INFORMATION ON HOW PLAID COLLECTS, USES, STORES, AND HANDLES YOUR DATA, PLEASE VISIT https://plaid.com/how-we-handle-data/. IF THERE IS ANY INCONSISTENCY BETWEEN PLAID’S COMMITMENT AND THESE TERMS REGARDING PLAID’S ACTIVITIES, THEN PLAID’S COMMITMENT IS CORRECT.
Provide Accurate Information. To preserve the integrity of our Services and prevent bad actors from misusing our Services, you, the end user, agree to provide true, accurate, current, and complete information about yourself, and you agree to not misrepresent your identity or your account information. You agree to keep your account information up to date and accurate.
Misuse of Services. You agree to not interfere with Virtumundo’s Site and Services and to not access or attempt to access them using a method or purpose other than the intended use. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Proprietary Rights. You acknowledge and agree that using our Site and Services does not give you ownership of any intellectual property rights in or associated with our Site or Services. You acknowledge and agree that using our Site and Services does not give you a license or right to use any intellectual property rights in or associated with our Site or Services outside of the scope of your use of the Virtumundo Site and Services. You acknowledge and agree that neither these Terms nor your use of Virtumundo’s Site and Services grant you the right to use any trademarks, branding, or logos shown, used, or otherwise incorporated in our Site and Services. You acknowledge and agree to not remove, obscure, or alter any legal notices displayed in or along with our Services. You acknowledge and agree to not reverse engineer or reverse compile any of the Service’s technology.
Content You Provide. Virtumundo’ Site and Services, including the community forum and blogs, may contain interactive services that allow you to contribute, post, submit, publish, display, or transmit content such as but not limited to: questions, responses to questions, commentary, observations, solutions, and spreadsheet templates and tools that you create or otherwise provide (“User Content”). User Content does not include your Financial Data. By creating or providing User Content within Virtumundo’s Site or Services, you grant Virtumundo and its Service Providers successors and assignees a fully paid, perpetual, worldwide right and license to use, reproduce, modify, display, perform, distribute and otherwise disclose such User Content to provide the Services. By submitting Content, you represent and warrant that you own or control all rights in your User Content sufficient to grant the above license, that you are responsible for any User Content that you create or provide, and that you take full responsibility for the legality, accuracy, and appropriateness of such User Content.
By providing interactive services within Virtumundo’s Site and Services, such as a community forum and blogs, we strive to foster a spirit of community and sharing. To this end, you agree to the following regarding any User Content you provide and for your general use of Virtumundo’s Site and Services.
You will be kind, considerate, and respectful.
You will not promote things for sale in or out of the community unless it builds on or enhances a Virtumundo solution – this is about sharing ideas, questions, and solutions related to financial data, finance, and the Virtumundo Site and Services.
You will not share malware. We may (but are not responsible to) restrict User Content containing or otherwise incorporating hidden scripts that other users can’t easily review and audit.
You acknowledge and agree that Virtumundo makes no assurances about our Services, User Content, your Financial Data, or any solutions or tools in the community or add-ons, which could cause a loss of data or could corrupt data.
You acknowledge and agree that Virtumundo can modify and build from your User Content and use such as inspiration for new products and solutions that we build and share either in the community or in our Services.
You acknowledge and agree that Virtumundo reserves the right to terminate users from the community for any reason and reserve the rights to modify or delete posts for any reason. Should Virtumundo modify or delete a post, such action will be noted within the community.
Your use of the Services is subject to the following additional restrictions:
You represent, warrant, and agree that you will not contribute any User Content, Financial Data, or otherwise use the Services or interact with the Services in a manner that:
Infringes or violates the intellectual property rights or any other rights of anyone else (including Virtumundo);
Violates any law or regulation, including any applicable export control laws;
Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
Jeopardizes the security of your MyStockData account or anyone else’s (such as allowing someone else to log in to the Services as you);
Attempts, in any manner, to obtain the password, account, or other security information from any other user;
Violates the security of any computer network, or cracks any passwords or security encryption codes;
Runs Maillist, Listserv, any form of auto-responder or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure);
“Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or User Content (through use of manual or automated means);
Copies or stores any significant portion of the Content;
Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services.
A violation of any of the foregoing is grounds for termination of your right to use or access the Services.
Google, Meta, and Microsoft Accounts. You may need a Google Account, Meta, or Microsoft Account to use some of our Services. Your use of Google’s, Meta’s, or Microsoft’s software and services is governed by Google’s, Meta’s, and Microsoft’s terms and privacy policies. To protect your Google, Meta, and Microsoft Account and related data provided to, or by, Virtumundo, keep your password confidential. You agree that you are responsible for all activity that occurs with relation to your Google, Meta, and Microsoft Account.
Privacy and Data Usage. Virtumundo’s Privacy Policy explains how we treat your personal data and protect your privacy when you use our Site and Services. By using our Services, you agree that Virtumundo can use such personal data accordingly.
Free and Paid Plans. While you may use some of our Services for free by enrolling in the Free Plan, if you choose to enroll in our Paid plans (the “Paid Plans”), you will be charged a subscription fee. The subscription fee for these Services (“Subscription Fee”) will be charged to you in advance, to the credit card you provided upon enrollment in the particular Paid Plan. Subscription Fees are refundable at VM’s sole discretion, and typically in a pro rata fashion. Your enrollment in the Paid Plan(s) will be automatically renewed every twelve (12) months. VM will notify you prior to the expiration of the twelve (12) month Paid Plan term; if you wish to cancel auto-renewal of the Paid Plan for the following year, you must notify VM within 3 days of your receipt of an auto-renewal notice from VM. VM may change the Subscription Fee upon notice to you, but such change will only take effect once your then-current Paid Plan term has ended. If you do not wish to pay the new Subscription Fee, your only remedy shall be to cancel your enrollment in the Paid Plan for the following year, prior to the expiration of your then-current Paid Plan term. You may cancel your Paid Plan subscription at any time, but again, refunds will be granted, typically in a pro rata fashion, at VM’s sole discretion.
Though some of our Services are currently free, Virtumundo reserves the right to require payment of fees for certain or all Services. You shall pay all applicable fees, as described on the Website in connection with such Services selected by you. Virtumundo reserves the right to change its price list and to institute new charges at any time, upon notice to you, which may be sent by email or posted on the Website. Your use of the Services following such notification constitutes your acceptance of any new or increased charges.
Any free trial or other promotion that provides access to a Paid Plan must be used within the specified time of the trial. You must stop using a Paid Plan before the end of the trial period in order to avoid being charged for that Paid Plan. If you cancel prior to the end of the trial period and are inadvertently charged for a Paid Plan, please contact us at info@mystockdata.com.
Modifying and Terminating our Services. You acknowledge and agree that Virtumundo regularly changes and improves our Site and Services, that we may add or remove functionalities or features, that we may suspend or stop a Service altogether, and that we may also stop providing Services to you or add or create new limits to our Services at any time. You can stop using our Site and Services at any time.
You’re free to stop using our services at any time, by contacting us at info@mystockdata.com; please refer to our Privacy Policy, as well as the licenses above, to understand how we treat information you provide to us after you have stopped using our Services.
Virtumundo is also free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms. Virtumundo has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
Account termination may result in destruction of any Financial Data and User Content associated with your account, so keep that in mind before you decide to terminate your account. We will try to provide advance notice to you prior to our terminating your account so that you are able to retrieve any important data you may have stored in your account (to the extent allowed by law and these Terms), but we may not do so if we determine it would be impractical, illegal, not in the interest of someone’s safety or security, or otherwise harmful to the rights or property of Virtumundo.
If you have deleted your account by mistake, contact us immediately at info@mystockdata.com – we will try to help, but unfortunately, we can’t promise that we can recover or restore anything.
Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.
DISCLAIMER OF WARRANTIES. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: YOUR USE OF OUR SITE AND SERVICES AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT (INCLUDING THAT OF THIRD PARTIES) INCLUDED IN OR ACCESSIBLE FROM THE SITE AND SERVICES ARE AT YOUR SOLE RISK. THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. VIRTUMUNDO AND VIRTUMUNDO’S SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND AS TO THE SITE AND SERVICES AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT (INCLUDING THAT OF THIRD PARTIES) INCLUDED IN OR ACCESSIBLE FROM THE SITE AND SERVICES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
VIRTUMUNDO AND VIRTUMUNDO’S SERVICE PROVIDERS MAKE NO WARRANTY (i) THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, (ii) THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, (iv) THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS, AND (V) THAT ANY ERRORS IN THE TECHNOLOGY WILL BE CORRECTED.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE AND SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. ALL DISCLAIMERS OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THESE TERMS) ARE MADE FOR THE BENEFIT OF BOTH VIRTUMUNDO, AND VIRTUMUNDO’S SERVICE PROVIDERS, AND VIRTUMUNDO’S AFFILIATES AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES, AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNEES. VIRTUMUNDO’S SERVICE PROVIDERS AND VIRTUMUNDO’S AFFILIATES MAY HAVE ADDITIONAL OR DIFFERENT WARRANTIES REGARDING THEIR THIRD PARTY SERVICES. THE FORGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
If you believe that your Financial Data made available through the Services is inaccurate, then you should contact your Data Source that is responsible for maintaining or otherwise providing such Financial Data.
LIMITATION OF LIABILITY. You acknowledge and agree that neither Virtumundo, or Service Providers nor any of their affiliates, account providers or any of their affiliates will be liable for any harms, for example but not limited to: direct, indirect, incidental, special, consequential, punitive, or exemplary damages, damages for loss of profits, goodwill, use, data or other intangible losses, even if Virtumundo or Service Providers have been advised of the possibility of such damages, resulting from: (i) the use or the inability to use the services; (ii) the cost of getting substitute goods and services; (iii) any products, data, information or services purchased or obtained or messages received or transactions entered into, through or from the services; (iv) unauthorized access to or alteration of your transmissions or data; (v) statements or conduct of anyone on the site and services; (vi) the use, in ability to use, unauthorized use, performance or non-performance of any third party account provider site, even if the provider has been advised previously of the possibility of such damages; or (vii) any other matter relating to the services.
YOU ACKNOWLEDGE AND AGREE THAT YOU PROVIDE YOUR LOG-IN CREDENTIALS (“CREDENTIALS”) TO YOUR DATA SOURCE ACCOUNTS AT YOUR OWN RISK.
BY USING OUR SERVICES YOU AGREE THAT THE DATA SOURCES THAT MAINTAIN YOUR ACCOUNTS AND ANY THIRD PARTIES THAT INTERACT WITH YOUR CREDENTIALS OR ACCOUNT DATA IN CONNECTION WITH OUR SERVICES ARE NOT LIABLE FOR ANY LOSS, THEFT, COMPROMISE, OR MISUSE WHATSOEVER IN CONNECTION WITH OUR SERVICES (INCLUDING NEGLIGENCE), EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
DATA SOURCES MAKE NO WARRANTIES OF ANY KIND RELATED TO THE DATA PROVIDED BY OUR SERVICES–WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. NO DATA PROVIDED BY OUR SERVICES IS AN OFFICIAL RECORD OF ANY OF YOUR ACCOUNTS.
Indemnification. You agree to indemnify and hold Virtumundo, its affiliates, its Service Providers, and their respective officers, directors, agents, employees, representatives, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to any third party claims relating to (a) your use of the Site and/or Services (including any actions taken by a third party using your account), and (b) your violation of these Terms. In the event of such a claim, suit, or action (“Claim”), we will attempt to provide notice of the Claim to the contact information we have for your account (provided that failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder).
Governing Law. You agree that your relationship with Virtumundo under these Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to any choice or conflict of laws, rules or provisions. All claims arising out of or relating to these Terms, the Site, or the Services will be instituted exclusively in the federal or state courts of Monroe County, New York, USA, and you and Virtumundo consent to personal jurisdiction in those courts. You further agree to attempt informal resolution prior to instituting any legal action, mediation, or arbitration.
Waiver, Serviceability, Survival, and Other Agreements. You acknowledge and agree that if Virtumundo does not exercise or enforce any legal right or remedy contained in these Terms, such will not be a waiver of Virtumundo’s rights and such rights and remedies will remain available to Virtumundo.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.
All covenants, agreements, representations, and warranties made in these Terms will survive your acceptance of these Terms and the termination of these Terms.
These Terms represent the entire understanding and agreement between you and Virtumundo regarding the Site and Services and will supersede all other previous agreements, including any prior version of these Terms.
